1. Protecting Users' personal data is of the utmost importance to the Owner of this website. The Owner makes every effort to ensure that Users feel safe when entrusting their personal data while using the website.

2. A User is a natural person, legal person or organisational unit without legal personality which is granted legal capacity by law and uses the electronic services available on the website.

3. This privacy policy explains the principles and scope of processing the User's personal data, their rights and the obligations of the data controller, and provides information about cookies.

4. The Controller uses modern technical and organisational measures to provide a high level of protection for processed personal data and prevent access by unauthorised persons.

Personal data controller

The personal data controller is the entrepreneur Ms Angelika Skrobot, trading as DigitalSmartie, with its registered office at Libusza 511, 38-306 Libusza, Poland, Tax Identification Number (NIP): 7382158122 (hereinafter referred to as the “Owner”).

Purpose of personal data processing

1. The Controller processes the User's personal data for the purposes of:

contacting the person or company completing the contact form
sending information about news and promotions, which also involves processing personal data to send commercial information about, among other things, new products or services, promotions or sales
direct marketing of products, securing and pursuing claims or defending against claims by the User or a third party, as well as marketing third-party services and products or the Controller's own marketing other than direct marketing

2. The User may also consent to receiving information about news and promotions. The Controller will then also process personal data to send the User commercial information about, among other things, new products or services, promotions or sales.

3. Personal data is also processed to fulfil the Controller's legal obligations and perform tasks in the public interest, including tasks relating to security and defence or retention of tax records.

4. Personal data may also be processed for direct marketing of products, securing and pursuing claims or defending against claims by the User or a third party, as well as marketing third-party services and products or the Controller's own marketing other than direct marketing.

Legal basis for processing personal data

1. Personal data is processed in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation), OJ EU L 119, 4 May 2016, pp. 1–88, hereinafter referred to as the “GDPR”.

2. The Controller processes personal data only after obtaining the User's prior consent.

3. Consent to the processing of personal data is entirely voluntary.

User rights

1. The User may ask the Controller for information about the scope of personal data processing at any time.

2. The User may request that their personal data be corrected or rectified at any time.

3. The User may withdraw consent to the processing of their personal data at any time without giving a reason. The request may concern a specific processing purpose, such as withdrawing consent to receive commercial information, or all processing purposes. Withdrawing consent for all purposes will result in deletion of the User's account from the website, together with all personal data previously processed by the Controller. Withdrawal will not affect actions already taken.

4. The User may request deletion of their data at any time without giving a reason. The request will not affect actions already taken. Deleting the data also means deleting the User's account together with all personal data stored and processed by the Controller up to that point.

5. The User may object to personal data processing at any time, either for all personal data processed by the Controller or for a limited scope, such as processing for a specified purpose. The objection will not affect actions already taken. An objection will result in deletion of the User's account together with all personal data stored and processed by the Controller up to that point.

6. The User may request a restriction of personal data processing for a specified or indefinite period but within a specified scope, and the Controller is obliged to comply. The request will not affect actions already taken.

7. The User may ask the Controller to transfer their processed personal data to another entity. To do so, they should send a request specifying the recipient entity's name and address and the specific data they wish to transfer. Once the User confirms the request, the Controller will transfer the data electronically to that entity. Confirmation is necessary to protect the User's personal data and ensure the request comes from an authorised person.

8. The Controller will inform the User of the action taken within one month of receiving any of the requests listed above.

Personal data retention period

1. As a rule, personal data is retained only as long as necessary to fulfil the contractual or statutory obligations for which it was collected. It will be deleted as soon as retention is no longer necessary for evidential purposes under civil law or to meet a statutory retention obligation.

2. Contract information is retained for evidential purposes for three years from the end of the year in which the business relationship with the User ended. Data will be deleted after the statutory limitation period for contractual claims expires.

3. The Controller may also retain archived transaction information where retention relates to claims available to the User, for example under warranty.

4. If no contract has been entered into between the User and the Owner, the User's personal data is retained until their website account is deleted. The account may be deleted following a User request, withdrawal of consent to processing or an objection to processing.

Entrusting processing to other entities

1. The Controller may entrust processing to cooperating entities to the extent necessary to complete transactions, for example to prepare ordered goods, deliver shipments or send the Controller's commercial information (the latter applies to Users who have consented to receiving it).

2. Apart from the purposes described in this Privacy Policy, Users' personal data will not be disclosed to third parties or transferred to other entities for sending those third parties' marketing materials.

3. Website Users' personal data is not transferred outside the European Union.

4. This Privacy Policy complies with Article 13(1) and (2) of the GDPR.
